ARTICLE 1: AREA OF APPLICATION
These general conditions of sale apply exclusively between Miller and any person
visiting or making a purchase via the website www.miller.fr. These conditions apply to
the exclusion of all other conditions, in particular those prevailing in the shop. Any
clause to the contrary is in all circumstances unenforceable, unless it has been
expressly accepted by ourselves.
All persons browsing the website can familiarise themselves with the general conditions
of sale on the website www.miller.fr. These general conditions of sale are subject to
amendment, the applicable conditions are those enforced on the site on the date the
order is placed.
By placing an order, the customer expressly accepts these conditions.
ARTICLE 2 - PRICES
The prices of our products are shown in Euros including all taxes (VAT + any other
taxes) excluding any contribution to handling and shipping costs. The prices of our
products are public prices. If an order is placed for dispatch to a country other than
mainland France, the recipient will be responsible for payment of any customs duties or
local taxes charged. All orders, whatever their origins, are payable in Euros. Miller
reserves the right to amend its prices at any time, but goods will be invoiced on the
basis of current charges on the date the orders are registered. The price to be paid by
the customer is shown on the Order Confirmation and the invoice. The goods remain the
property of Miller until full receipt of payment by Miller. Full payment must be made
before the goods are delivered.
Despite our best efforts, it is possible that a limited number of items shown on our
website, amongst the hundreds on sale, may contain a price error. Please be assured,
however, that we will check prices during the dispatch process for your order. If the
corrected price is lower than the price displayed on the website, we will apply the
lowest price, and will send you your item. If the corrected price is higher than the
price displayed on the website, we will inform you accordingly, and will cancel your
order unless you choose to accept the order at the new price.
ARTICLE 3 - ORDER
Information on the website www.miller.fr is given for information only, and will be
confirmed at the latest at the time of delivery. This confirmation will contain
information which becomes contractual. Miller reserves the right to cancel or refuse any
order from a customer with whom a dispute exists relative to payment of a previous
order. Any change in our customers’ situation entitles us to cancel current orders or
demand guarantees.
All customer orders are deemed to be firm and definitive upon receipt by Miller.
Acceptance of the customer’s order by Miller is confirmed by dispatch to the customer of
an order confirmation. The customer must check the order confirmation and immediately
inform Miller of any error or discrepancy. Otherwise, Miller will deliver the product in
accordance with the order confirmation, which will be binding on the customer.
Any subsequent changes to the order for any reason whatsoever, particularly in terms of
goods or delays to delivery, must be made in writing, and are possible only with the
express prior agreement of Miller.
ARTICLE 4 - VALIDATION
You declare that you are familiar with and have accepted these general conditions of
sale before your order is placed. Validation of your order is therefore equivalent to
acceptance without reservation of these General Conditions of Sale. Unless proved to the
contrary, the data recorded by miller.fr constitute a proof of all the transactions
between miller.fr and its customers.
ARTICLE 5 - AVAILABILITY
Our offers of goods and prices are valid for as long as they appear on the website,
subject to availability of stock. You will be informed about the availability of goods
when you place your order.
If any goods should prove to be unavailable after you have placed your order, Miller
will immediately notify you by all suitable means of a new delivery date, as soon as it
receives such information. In this case, the customer is entitled to cancel his order
and be reimbursed for any on-account payment he has made to Miller.
Reimbursement will be made, at Miller’s discretion, either by credit to the customer’s
bank account or by cheque at the latest within thirty days of payment of the sums by the
customer.
If any goods should prove to be unavailable, Miller may deliver to the customer another
product of equivalent quality and price to that initially ordered, subject to the
customer’s express agreement.
In the event of default, Miller reserves the right to cancel all or part of the orders
already paid for, and in this case is obliged to reimburse the customer by all suitable
means for any sums which he has already paid within a period of 30 days of payment by
the customer.
ARTICLE 6 - DELIVERY
Delivery costs are applicable in accordance with the information shown on the site.
Miller reserves the right to amend its delivery charges at any time, but delivery
charges will be invoiced on the basis of current charges on the date the orders are
registered.
The goods are delivered to the delivery address which you specified during the order
process. The delivery period is 10 working days from receipt of payment. This
corresponds to an average normal delivery period, and the handling and delivery periods
for mainland France.
However, the period for validation of payment and dispatch of the order varies,
depending on the method of payment chosen, and may reach the statutory maximum period of
30 days.
In the event of delayed delivery, the customer can contact miller.fr’s Customer Services
on +33 1 42 61 63 13 or by email to contact@miller.fr. The customer has the option of
cancelling his order if it has not been delivered at the latest within ten working days
of the delivery date stated by Miller.fr, unless this delay in delivery is due to a case
of force majeure as defined in the case law of the French courts, or by a transport
delay. Miller.fr cannot then be held liable for the consequences, and the customer may
not benefit from any claims for damages, deduction from or cancellation of the order.
In the event of cancellation, Miller.fr will request its Bank to reimburse the customer
within 10 working days of the request for cancellation by the customer.
The customer must note any package or product which is missing, damaged or non-compliant
on the delivery note before adding his signature.
The customer is responsible for guaranteeing his rights by complying with Article L133-3
of the Commercial Code and carrying out the checks necessary on receipt of the goods,
expressing any reservations necessary and, for any damage noted, informing us
immediately by registered letter with acknowledgement of receipt within three days,
under penalty of foreclosure.
ARTICLE 7 - PAYMENT
For your safety, the regulations are the subject of our full attention. We systematically check the consistency of the information we have. In order to fight effectively against the fraudulent use that could be made of your means of payment, Miller reserves the right to request a photocopy of the buyer's identity card as well as proof of address for all orders.
- Bank transfer:
The transfer must reach Miller within 4 working days, otherwise the availability indicated at the time of the order will no longer be guaranteed, the order will be canceled automatically.
- Payment in installments with Alma:
Installment/deferred payment is available through our partner Alma. Payment security is provided by Alma and its service providers. All payments are protected by 3D Secure. Only purchases between €50 and €4,500 are eligible for payment with Alma. The Client does not pay any fees.
Alma is the electronic payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the Civil Code. Any termination of the T&Cs that bind the Seller and the customer results in the termination of the T&Cs between Alma and the customer.
If the Customer wishes to pay by another means of payment, he must first contact Miller.fr customer service on +33 1 42 61 63 13 or by email at contact@miller.fr and await the express written agreement of Miller.
Except with the prior and express agreement of Miller for an extension of the due date appearing on the invoice, any delay in payment shall cumulatively entail: the immediate and automatic payment of all sums owed by the Customer, regardless of the method of payment provided, the application of late payment penalties set at one and a half times the legal interest rate in force at the due date, any month started being fully due, the invoicing, as a penalty clause, of a lump sum of 15 euros per file. In addition, Miller reserves the right to suspend or terminate all current orders from the Customer, after the sending of a formal notice that has remained unsuccessful. The amount of late payment interest may be automatically charged against any discounts, rebates or rebates specially granted by Miller.
ARTICLE 8 - RESERVATION OF OWNERSHIP
Whatever the method of payment, goods delivered remain the exclusive property of Miller
until full payment without reservation has been received. Payment must be made before
the goods are delivered.
This clause, which is applicable within the framework of law no. 80.335 of 12 May 1980
relative to the effects of clauses on reservation of ownership within the context of
sale contracts, is equally enforceable against third parties in the event of suspension
of payment by the purchaser and insolvency proceedings.
ARTICLE 9 - SATISFIED OR REFUNDED
You have a period of 14 days from receipt of goods to return any which do not suit you.
In accordance with the law, the product or products and the shipping cost will be
refunded in full.
A customer wishing to return a product must make a detailed request in writing before
returning any goods. The customer may proceed to return the product after obtaining
Miller’s express authorisation. Miller will proceed, at the customer’s choice, to
exchange or refund the product or products.
Returns are to be sent to Miller, 233 Rue Saint Honoré, 75001 Paris, France in their
original packaging, complete (with accessories, instructions etc.) in perfect condition
and accompanied by a copy of the invoice. Items which are returned incomplete, spoiled,
damaged or dirty by the customer will not be taken back, nor will products which have
been modified. The refund will be deferred until the goods have been received.
If you have exceeded the statutory period of 14 days, on a case by case basis Miller may
take back your goods and credit your customer account with the corresponding value,
without any obligation.
In all cases, the costs of the return are the responsibility of the customer.
ARTICLE 10 - CONFORMITY OF PRODUCTS
We undertake to exchange defective products or products which do not correspond to your
order. In this case, please list them in detail in writing, and return the product or
products to us. Miller will then exchange the product or products at your choice. This
request must be made within fourteen working days of delivery. No complaint made outside
of this period will be accepted, except on a case by case basis without obligation.
You will be refunded for the shipping costs on the basis of the rate invoiced and the
cost of sending returns will be refunded for residents of France only (excluding French
Overseas Department and Territories).
In all cases, you will benefit from the provisions of the statutory guarantee,
particularly those concerning hidden defects.
The provisions of this Article do not prevent you from benefitting from your right to
cancel (satisfied or refunded) provided for in Article 8.
ARTICLE 11 – REFUNDS
You have a period of 14 days, starting from receipt of the products, to request a refund
under the circumstances set out in Articles 8 and 9. Refunds will be issued by the same
method of payment as used for the purchase. However, with the customer’s agreement,
Miller may use a different method of payment without additional cost to yourself.
In the event of a reservation with withdrawal from the shop, the cancellation period of
14 days is not applicable.
No goods will be accepted as partial reimbursement for any reason whatsoever.

ARTICLE 13 - INTELLECTUAL PROPERTY
The presentation and content of the website www.miller.fr together constitute a work
protected under the law of copyright and of intellectual property for the whole world.
For this reason, and in accordance with the provisions of the Intellectual Property
Code, any full or partial representation of this website by any person whatsoever
without the express authorisation of Miller shall constitute an infringement. For
private use only, subject to different or more restrictive provisions in the
Intellectual Property Code.
ARTICLE 14 - LIABILITY
The products offered comply with current French laws. Miller does not incur liability in
the event of failure to obey the laws in the country where the products are delivered.
It is your responsibility to check with the local authorities what the possibilities are
for importing or using the products which you intend to order.
The photographs of jewellery are for information and illustration only, they are not
contractual. We recommend that you read the description of each product to find out its
precise characteristics; and in case of doubt, or if you require additional information,
please do not hesitate to contact us.
In the event of an obvious error between the characteristics of the product and its
representation and/or conditions of sale, miller.fr will not accept liability.
Miller’s IT team does everything possible to offer you available and verified
information, but cannot be held liable for errors, a lack of availability of functions
or the presence of a virus on its website.
In the case of hypertext linking to another site from miller.fr, the latter shall not be
liable for the content of information provided on these sites after the links have been
activated.
In the case of purchases for professional purposes, miller.fr shall not incur any
liability for any indirect damage arising from these clauses, loss of operation, loss of
profit, loss of opportunity, damages or costs.
They include all the essential elements required for any online sale.
ARTICLE 15 - GUARANTEE
All the watches purchased from Miller have been valued, photographed and serviced in our
workshop if necessary.
You will receive an invoice which gives rise to a 1-year guarantee starting from the
date appearing on the invoice. During this 1-year period, Miller undertakes to repair
any manufacturing defects which exist at the time the watch is delivered, and any
faults. This guarantee only retains its validity on the express condition that the watch
is not subject to any work carried out on it except in the workshops approved by the
brand.
However, the watch’s guarantee does not cover: a problem caused by an accident,
a problem caused by incorrect handling,
a problem caused by lack of care or interventions by unauthorised third parties or the
consequential damage due to these.

ARTICLE 16 - PERSONAL DATA: IT AND CIVIL LIBERTIES
Miller undertakes not to divulge the information you provide on the forms which appear
on the website to any third party. These data are confidential. They will be used only
for processing your order and to strengthen and personalise communications and the
product offered to customers of miller.fr, in particular by information letters from
miller.fr to which you will have subscribed, and within the context of personalisation
of the site based on your main interests.
In accordance with the Data Protection and Civil Liberties Act of 6 January 1978, as
amended in 2004, you will have the right of access to your personal data, and the right

This contract is subject to French law.
The language of this contract is French.
In the event of a dispute, the Commercial Court in Paris has sole jurisdiction, whatever
the conditions of sale and method of payment accepted, even in the case of a recourse to
the guarantee or multiple defendants.
